2. Eligibility and Client Responsibilities

To use our Services, you must be legally capable of entering into binding contracts. If you are arranging services for another individual (the "Recipient"), you represent and warrant that you have the legal authority to act on their behalf.

Clients and/or their authorized representatives are responsible for:

• Providing accurate and complete information about the Recipient's needs, health conditions, preferences, and living environment.
• Ensuring a safe and suitable environment for our caregivers and staff.
• Communicating any changes in the Recipient's condition or needs promptly.
• Making timely payments for the Services as per the agreed schedule.
• Cooperating with NRI Nestham staff to facilitate the provision of Services.

3. Caregivers and Staff

NRI Nestham employs or contracts with qualified and vetted caregivers. While we strive to ensure the quality and reliability of our staff, we act as an agency coordinating services. Our caregivers provide non-medical assistance and companionship. They do not provide medical diagnosis, treatment, or administer medications unless specifically agreed upon and permitted under applicable law and within the scope of their qualifications.

4. Fees and Payment

Fees for our Services will be detailed in the Service Agreement. Payment terms, including frequency and accepted methods, will also be specified. Failure to make timely payments may result in suspension or termination of Services.

5. Limitation of Liability

NRI Nestham strives to provide high-quality, compassionate care. However, our Services are non-medical in nature. We are not liable for:

• Medical emergencies or outcomes unrelated to the direct actions or negligence of our staff acting within their scope of duties.
• Loss or damage to personal property unless caused by the direct negligence of our staff.
• Events outside our reasonable control (force majeure).
• Any damages exceeding the total fees paid for the specific service period during which the alleged incident occurred.

Clients are advised to maintain appropriate insurance coverage for the Recipient and their property.

6. Confidentiality and Privacy

We are committed to protecting the privacy and confidentiality of our clients and Recipients. Our practices regarding the collection, use, and disclosure of personal information are governed by our Privacy Policy, which is incorporated by reference into these Terms.

7. Termination

Either party may terminate the Service Agreement with prior written notice as specified in the agreement. We reserve the right to terminate Services immediately if:

• The safety of our staff is compromised.
• Client fails to make payments.
• There is a significant breach of these Terms or the Service Agreement.
• The Recipient's needs change significantly beyond the scope of services we can safely provide.

8. Intellectual Property

The content on our website, including text, graphics, logos, and images, is the property of NRI Nestham or its licensors and is protected by copyright and other intellectual property laws. You may not use, reproduce, or distribute any content from our website without our prior written permission.

9. Governing Law
